Terms of Service

1. Definitions

• "Platform": the mi day websites, ERP, marketplace directory, mobile applications, and related services.
• "Organization": a nursery, kindergarten, school, sports academy, or similar establishment registered on the platform.
• "Owner": the person who submits an application or manages an organization account.
• "Listing": an organization's public page in the mi day marketplace directory.
• "Free Start": the free application-based entry plan that provides a directory listing and related marketplace features, without school-management modules.

2. Accounts and applications

• You must provide accurate, complete, and current information in every application and keep your account details up to date.
• Applications (including Free Start) are subject to review; we may approve, request more information, or decline an application at our discretion, and we aim to respond within 24 hours on business days.
• You are responsible for safeguarding your login credentials and for all activity under your account.
• One commercial registration (CR) may hold one organization account; duplicate or fraudulent applications may be refused or removed.

3. Free Start scope

• Free Start provides a marketplace directory listing and related visibility features at no charge. It does not include school-management (ERP) modules such as attendance, assessments, or billing.
• We may adjust the features included in the free tier, introduce fair-use limits, or offer paid upgrades. Material reductions will be announced in advance.
• A free account that remains inactive or unreachable for an extended period may be suspended after notice.

4. Listing content and responsibility

• You are solely responsible for the content of your listing and organization pages — names, descriptions, photos, prices, seat availability, and any replies to families.
• Content must be lawful, accurate, non-misleading, and must not infringe the rights of others (including photo consent for any children or staff shown).
• We may edit formatting, request corrections, or remove content that violates these Terms, applicable law, or platform quality standards.
• Reviews and ratings shown on listings may come from platform users and public sources; we do not guarantee, and are not liable for, their accuracy.

5. Verification and documents

• We verify commercial registrations against official sources (including Wathq) where possible; where automatic verification fails, our team verifies manually.
• You authorize us to process the documents you upload (commercial registration certificate, VAT certificate, licences) for verification, compliance, and record-keeping.
• Submitting forged or altered documents is grounds for immediate termination and may be reported to the competent authorities.

6. Payments

The Free Start plan is free of charge. Paid plans, upgrades, and any future booking or payment features are governed by the pricing and payment terms presented at the time of purchase, including applicable VAT. Where a licensed payment gateway is used, its terms apply to the payment transaction. This section will be expanded when online payments launch.

7. Data protection

We process personal data in accordance with the Saudi Personal Data Protection Law (PDPL) and our Privacy Policy. Organizations remain the primary custodians of the family and child data they enter into the platform; we process it on their behalf and instructions. Platform data is hosted in the Kingdom of Saudi Arabia.

8. Suspension and termination

• You may close your account at any time by contacting us; closure does not erase obligations that accrued before it.
• We may suspend or terminate accounts that breach these Terms, submit fraudulent information, abuse the platform, or create legal or security risk — with notice where practicable.
• Upon termination we retain data only as required by law or legitimate accounting needs, then delete or anonymize it in line with the Privacy Policy.

9. Disclaimers and liability

The platform is provided "as is" and "as available". To the maximum extent permitted by law, mi day disclaims implied warranties and is not liable for indirect or consequential losses, loss of profits, or loss of data. Nothing in these Terms excludes liability that cannot be excluded under the laws of the Kingdom of Saudi Arabia.

10. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from them is subject to the exclusive jurisdiction of the competent courts and committees of the Kingdom of Saudi Arabia.

11. Changes and contact

We may update these Terms from time to time; the date above reflects the latest revision and material changes are announced on the platform. Continued use after a change constitutes acceptance.
